Wander Well Collective Terms of Service

Welcome to Wander Well Collective.

These Terms of Service (“Terms”) govern your access to and use of the Wander Well Collective website, applications, platform, and related services (collectively, the “Platform”).

The Platform is owned and operated by Wander Well Collective, Inc., a Delaware corporation, with its principal place of business at:

By accessing the Platform, creating an account, applying for membership, or using any of the services provided by Wander Well Collective, you represent that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Platform.

Your use of the Platform is also governed by our Privacy Policy and Code of Conduct, which form an integral part of these Terms.


I. Definitions

For the purposes of these Terms:

Account
The account created by an individual to access the Platform.

Application
The process by which a person applies to become a Member of Wander Well.

Listing
Any property, experience, or offering described on the Platform by a Member.

Member
A user who has been accepted into Wander Well Collective and maintains an active membership.

Hosting Member (Host)
A Member who offers a property or experience on the Platform.

Guest Member (Guest)
A Member who books a stay or experience.

Stay
A visit by a Guest Member to a Host Member’s property arranged through the Platform.

Experience
Any activity, gathering, event, or offering posted by a Member.

Wander Well Tokens (“Tokens”)
Non-monetary points used to exchange stays and experiences within the community.

Membership
A paid subscription that grants access to the Platform and its services.

Platform
The Wander Well website, applications, and any related services.

We, Us, Our, Wander Well
Wander Well Collective, Inc.

You, Your
Any user, applicant, or Member using the Platform.


II. Purpose of the Platform

Wander Well Collective is a private, application-based membership community designed to connect like-minded individuals for:

- Home stays using a token-based exchange

- Community-led experiences

- Volunteer opportunities

- Cultural immersion

- Wellness-oriented travel

- Meaningful connection

Wander Well is a platform provider only.

We do not:

- Own or operate member properties

- Act as a real estate broker

- Provide travel agency services

- Guarantee accommodations

- Provide insurance

All stays, experiences, and interactions are agreements directly between Members.


III. General Use of the Platform

Your use of the Platform is conditioned on your compliance with these Terms and our Code of Conduct.

You agree:

- Not to provide false or misleading information

- Not to create multiple or fraudulent accounts

- Not to use the Platform for commercial rentals

- Not to harass, discriminate, or threaten other Members

- Not to post illegal, abusive, or offensive material

- Not to collect Member data without consent

- Not to use bots, scrapers, or automated tools

- Not to arrange stays outside the Platform

You also agree:

- You are responsible for your communications and interactions

- You assume all risk related to stays and experiences

- You will comply with all applicable laws


IV. Membership Rules

1. Application and Acceptance

Membership is application-based.

To apply, you must:

- Be at least 18 years old

- Provide accurate personal information

- Agree to these Terms

- Be approved by Wander Well

Wander Well reserves the right to:

- Accept or reject any application

- Suspend or terminate membership at any time

Membership is for personal, non-commercial use only.


2. Active Member Policy

As a condition of maintaining active membership, all Members agree to:

Platform Participation Requirement
Members must use Wander Well products or services at least once every two (2) calendar years.

Volunteer Commitment
Members agree to volunteer at least once per calendar year, either through a Wander Well–organized initiative or an approved charitable effort aligned with Wander Well’s mission and Code of Conduct.

Failure to meet these requirements may result in:

- Account suspension

- Restricted booking privileges

- Non-renewal of membership

Wander Well reserves the right to determine compliance.


3. Member Access Contribution

Members agree to provide Wander Well Member access to their property or approved hosting space for a minimum of fourteen (14) days per calendar year, unless otherwise approved in writing by Wander Well.

Availability does not guarantee bookings and remains subject to Member discretion and house rules. However, Members must offer reasonable access consistent with this minimum annual requirement.

Failure to meet this obligation may result in suspension, restriction, or termination of membership.


4. Charitable Participation

As part of Wander Well Collective’s mission as a Public Benefit Corporation serving local charities, Members agree to:

- Nominate at least one charitable organization meaningful to them

- Support Wander Well’s charitable initiatives

- Participate in various community projects, charity events, or fundraising efforts when reasonably able

- Participation does not require mandatory monetary contributions but reflects alignment with Wander Well’s public benefit mission.


5. Membership Duration and Renewal

Memberships are offered on:

- Monthly plans

- Annual plans

Memberships automatically renew unless canceled before the renewal date.

If a membership expires:

- Access to the Platform may be restricted

- Tokens may become unusable until membership is renewed


6. Membership Fees

Membership fees:

- Are required to participate in stays

- May change at any time

- Are non-refundable


7. Account Responsibility

You are responsible for:

- Maintaining the confidentiality of your login credentials

- All activity under your account

- Updating your account information


V. Listings

Hosts must:

- Provide accurate, up-to-date information

- Disclose all relevant property details

- Set clear house rules

- Comply with local laws and regulations

You represent that:

- You have the legal right to host

- Your listing is truthful

- Your property is safe and habitable

Wander Well does not guarantee:

- Accuracy of listings

- Member behavior

- Property conditions


VI. Tokens

1. Nature of Tokens

Tokens:

- Have no monetary value

- Cannot be bought, sold, or exchanged for money

- Cannot be transferred between accounts

- Exist solely within the Platform

2. Earning Tokens

- Members may earn Tokens by:

- Hosting stays

- Referring new members

- Participating in approved programs

3. Expiration of Tokens

Tokens expire one year after being earned.

If:

- Membership lapses, or

- Account is terminated,

- Tokens may be forfeited.


VII. Stays and Exchanges

1. Nature of Stays

Stays are arranged directly between Members.

Wander Well is not a party to any stay agreement.

Hosts:

- Choose whether to accept guests

- Set house rules

- May charge cleaning fees

Guests:

- Must follow house rules

- Must respect the property

- Are responsible for all occupants

2. Fees

Each stay may include:

- A host-set cleaning fee

- A Wander Well journey fee

- These fees are required to complete the booking.


VIII. Security Deposits

- A standard security deposit is required for stays.

- The deposit is pre-authorized on the guest’s payment method.

- The standard deposit amount is determined by Wander Well.

If damage occurs:

- The host must submit a claim within ten (10) days.

- Wander Well may hold or release the deposit accordingly.

If disputes arise:

- Funds may be held in escrow until resolved.


IX. Cancellations

1. Guest Cancellation

If a Guest cancels a confirmed Stay or Experience:

- A cancellation penalty of $495 USD will apply unless otherwise waived in writing by Wander Well.

- The Host may choose whether to return Tokens.

- Journey fees and applicable service fees are non-refundable unless required by law.

- Wander Well may intervene in documented emergency situations at its sole discretion.

2. Host Cancellation

If a Host cancels:

- Wander Well will attempt to find replacement stays.

- Replacement is not guaranteed.

- Repeated Host cancellations may result in account suspension or removal.


X. Experiences

Members may list experiences.

Experiences may:

- Be free or paid

- Be hosted by Members

Wander Well:

- Does not guarantee experiences

- Is not responsible for safety, quality, or outcomes


XI. Reviews and Ratings

After a stay or experience:

- Members may leave reviews

- Reviews must be honest and respectful

Wander Well may:

- Remove inappropriate reviews

- Suspend accounts for misconduct


XII. Account Suspension or Termination

Wander Well may suspend or terminate accounts if a Member:

- Violates these Terms

- Engages in harmful or illegal behavior

- Misrepresents listings or identity

- Termination may result in:

- Loss of membership

- Loss of tokens

- Cancellation of stays

- No refunds


XIII. Insurance

Hosts are responsible for:

- Maintaining appropriate insurance

- Ensuring legal compliance

- Wander Well does not provide insurance.


XIV. Messaging and Communications

The Platform may include messaging tools.

You agree:

- Messages are for community use only

- No spam or commercial solicitation

- Wander Well may review communications if necessary.


XV. Intellectual Property

All Platform content is owned by Wander Well or its licensors.

You may not:

- Copy

- Sell

- Distribute

- Modify

any content without written permission.

You grant Wander Well a license to use your uploaded content for platform operations and promotion.


XVI. Privacy

Your use of the Platform is governed by our Privacy Policy.


XVII. Disclaimer of Warranties

The Platform is provided “as is.”

Wander Well makes no warranties regarding:

- Listings

- Members

- Safety

- Availability

- Accuracy

You use the Platform at your own risk.


XVIII. Limitation of Liability

To the fullest extent allowed by law:

Wander Well is not liable for:

- Property damage

- Personal injury

- Theft

- Travel disruptions

- Member disputes

- Loss of tokens

Total liability will not exceed the amount paid for your membership.


XIX. Dispute Resolution

You agree that any dispute between you and Wander Well will be resolved by:

- Binding arbitration

- Conducted in the State of Florida

- On an individual basis only

You waive:

- The right to a jury trial

- The right to participate in class actions


XX. Applicable Law

These Terms are governed by the laws of the State of Florida, United States.


XXI. Miscellaneous

Severability
If any provision is invalid, the remaining provisions remain in effect.

No Waiver
Failure to enforce a provision does not waive our rights.

Assignment
Wander Well may assign its rights without notice.
